      Non migrating child rules

      Can you help My query is regarding a teen daughter (my step) who will be added to our visa but may not eventually make the choice of coming with us. If this is the case, the expensive agent says she would still have to come to oz with us to validate the visa then obviously go back. The inexpensive but sometimes old rules forums suggest she would just need a medical in uk. This cost is fine - I worry about the logistics of getting her in a plane back home if this isn't the case. Ps I think she will decide to stay with her mum btw
      Agent services started: 20 jan 2012 then dropped
      Hubby's ielts booked 10 and 31 march 2012 (!!) 7.5 and 8 and 8.5 and 8
      TRA sent 20 Feb - received by TRA 7 March Job accepted 19 March - sponsorhip in process Nomination accepted 17 May, Visa sent 19 May by express delivery

      I'm not sure what you're asking? Are you asking if she has to enter the country to activate the visa? It may vary by visa but it I'm sure it used to be that if you were a dependent on a visa you had to enter the country by the stated date to activate it. Or the visa stops being valid. I've not heard of any visa type where a dependent of a main applicant doesn't have to enter the country to hold a visa.

      If she is granted a PR visa she will need to validate it as far as I am aware. Also a PR visa usually has a 5 year validity for you to come and finally settle. If you don't do that the visa expires and then she would have to apply for a return residents visa if she wanted to come and live with you.

      If your step daughter is granted a visa then she will need to validate it by the initial entry date - if she does not do so then her visa will expire. As a migrating child she will need to have a medical.

      It used to be that non migrating children still required a medical - you will need to see if this is still the case - your agent should be able to advise you.
