My question is can he still apply for residency after 2 years, or as someone told me today they have to go back to the UK after 4 years to apply for PR whilst in the UK. This seems to be a bit extreme after living here for 4 years with your family and having to give up your job and pack everything up and return to the UK to do this.. ali Posted July 16, 2013 Report Share Posted July 16, 2013 They can apply for PR at any time, but before 2 years I believe they need to do a skills assessment or his employer may agree to sponsor them to the PR route. DyLeB Posted July 16, 2013 Report Share Posted July 16, 2013 They can apply at anytime if eligible. Either by employer sponsored or skilled migration. There are no onshore/offshore subclasses anymore so they can apply onshore. If employer agrees to sponsor them if work for the employer for 2 years in 457 visa it only means they don't need to do the skills assessment. There is no such thing as applying for residency, only visas can be applied for and your friend can apply for any visa they like at any time if they qualify for that visa. There is no 2 year rule although that is a common misnomer, people get it mixed up with needing a skills assessment. To your final comment, every 457 holder should be ready and prepared to have to return to the UK or wherever as this is a temporary visa.
