Jorje Posted January 9, 2014 Report Share Posted January 9, 2014 Hello to Everybody, We are still waiting for our visas, or at least that CO to contact us and I was wondering for the following: How long is valid this visa 190? I know that it is PR, but still. What I have in mind is the following: Let us propose that we have issued visa 190 (WA) and we move to Perth, for example. This will be great, our dream will come true ... and then...The reality!!! Let us say that after 3,4,5 months of searching of work, finally I have something , but money are not enough ( we are four). Then the question will be (may be) to come back in my origin country and to wait there for better times. Well, here is my question - do we have right with visa 190 to stay away from Australia for certain period of time, or we have to be in the State which sponsored us minimum 6 months per year, for example. Once granted you must enter Australia within 12 months of medicals or police checks whichever is the earlier. The visa is then valid for 5 years from grant. If I understand correct - after the visa is issued and I activate it ( within 12 months of medicals or police check) then I have about 5 years to make a decision whether to stay in Australia or not. Is this time, when you are in Australia, counts somewhere? I mean do I have to cover a minimum stay in the country? Or just I need a visa in my passport showing that it is activated and then after 5 years when expired I can ask to be renew it but without any other rules or conditions? The only reason to ask such questions is that obviously now is very difficult time to find a job as a Civil Engineer in Perth. I spent many years to make this dream come true and now when I am a step before the dreamed visas ( I cross my fingers) the construction market is dropping down. Hopefuly not for long time, but still. I do not want to stay in Perth, searching for a job several months and to waste all the money. Walkabout Posted January 10, 2014 Report Share Posted January 10, 2014 Hi Jorje, With a 190 you need to 'validate' it within 12 months of the medical or police checks (which ever is earliest) as you have stated. The visa is then valid for 5 years, you can come and go as you please. As your 5 years approaches you will need to apply for a residents return visa, there are conditions for doing this and I am not 100% sure but I believe that you need to have been in the country for 2 out of the 5 years and actually be in the country at the time of applying (or be able to show compelling extenuating circumstances why you are not and strong ties to the country). The other option is if you have done 4 years in the country is to apply for citizenship and to get you Aus passport. Jorje Posted January 10, 2014 Author Report Share Posted January 10, 2014 Hi Weston clan, This is what I found on the site of immi: If you became a permanent resident on or after 1 July 2007 the residence requirement is: You must have been living in Australia on a valid Australian visa for 4 years immediately before applying, including 1 year as a permanent resident, and You must not have been absent from Australia for more than 1 year during the 4 year period, including no more than 90 days in the year immediately before applying. So my understanding is that I have to be minimum 4 (four) years in Australia from 5 (five). I guess that visa expired after 5 (five) years. Jorje Posted January 11, 2014 Author Report Share Posted January 11, 2014 Yap, and this is what I found for Residence Return Visas Australian Immigration has announced that from 15 February 2012 the validity period for Resident Return Visas (Subclass 155) will be reduced from five years to one year when the applicant has not lived in Australia for more than two of the last five years. Please note that permanent residents who have spent at last two years in the last 5 years in Australia will still be granted a full five year RRV. Immigration officers will also be able to use their discretion and grant visas to applicants who are contributing to Australia's economy, but don't fully satisfy the physical residence requirements. So, after reading the information - it seams that the key factor is to be at least 2 years from 5 in Australia. After that you will be granted RRV for 5 years. What do you think verystormy? Walkabout Posted January 11, 2014 Report Share Posted January 11, 2014 Hi Jorje, Yes that is correct,as far as my understanding goes the key things are out of the 5 years that your visa is valid for you need; 2 years to qualify for a full residents return visa 4 years to qualify for citizenship. For me was a bad news that Civil Engineers are "restricted" in the Occupation List and that the salary level is dropping. My calculations are not precise and are based on the information on the Net. Of course it depends on me how I will "sell" myself there and what will be the outcome. Please, let me know what is your personal opinion about the construction market now in WA and particularly in Perth? Also, what do you thing should be a "normal" salary for 4 person in Perth? Of course, I am not talking about luxury, just normal life - including once per month a restaurant ( may be once per 3-4 months), elementary school, rent, car... just the everyday needs.
