Eng
I am currently on a 457 visa and have found a new company who want to take over my sponsorship. They would like me to sign a form that will ensure that I pay the company costs incurred in the process I.e.. If I leave them within 3 years. Is it legal under 457 conditions for the company to charge me if I leave earlier than 3 years? Eng
nikkiwd
sorry can't help but try contacting immi or a registered migration agent as they will know.
verystormy
A bit variable. The company are responsible for the nomination costs. But they can ask you to pay your application costs. If they are using an agent they can ask you to be liable for these if you leave.
Druid
I was obligated by my previous company for 2 years for all visa expenses incurred for my 457 & then for my PR visa, but under the terms of my PR visa I was obligated to them and WA for two years anyway, I did my two years. Nutnudger
It's not uncommon for company's to protect them selfs against the cost of paying for visa's if someone then later leaves, the company I'm with had an item in my contract that if I leave within 12 months then I would be liable for all the cost if I left within 12 -to- 24 months then I would have to pay 50% of the cost back. Plimthing
Not sure if its legal, but my company (airline in oz with a rodent on the tail!) didn't 'Bond' me for the cost of the 457visa but they did for the cost of relocation ($11.5K). I think it is quite normal for a company to protect its investment though.
