TheMackemSlayer
Hey y'all! I have a problem: When I was around 15/16 years old, I got into a fight and was arrested. It was no big deal, just a little scuffle and I was released with a warning, however, I have just recieved my police certificate back and it is reading 'No Live Trace', which means they do have criminal information on me but it has been 'stepped down' and is no longer relevant. The worry I now have is that this may now affect my visa application as I ticked the 'No' box when asked if I had any previous convictions (assumed this wouldn't be classed as one as I never went to court?). Do any of you guys have any info on this and, if so, could you possibly advise me on what I should now do. Cheers, Gary.
portlaunay
Sorry, can't help, maybe a migration agent can advise?
TheMackemSlayer
Yeah, I'm trying to contact my case officer to discuss but it normally takes a few days to get a responce so I thought I'd put it out to you guys first. Nevermind
flatpack
You don't have a conviction as you didn't go to court and get convicted. Did you get a caution? That is an admission of guilt but not a conviction. i'd be very surprised if it causes you any issues.
TheMackemSlayer
Sounds sillh but I honestly can't remeber if I got a caution or not. I was only a kid at the time. Think I was just warned but can't be sure. Either way, you'd think such a thing wouldn't affect anything but who knows. Just another delay in the visa process. verystormy
They will ask what it relates to and technically a caution is a conviction as you have to admit guilt. However, it will not be a bar to the visa. Depending on what they ask for will depend on if you need to appoint a migration agent
Bouncy
Hi there, mine said the same and ive never been In trouble with the police in my life, not even minor kids stuff! So I think this must be what they put in all their letters! My husbands said the same too and he's not had any involvement in his life either! Bouncy
Oops, sorry ours actually says no trace! Ignore me!!
ali
Your problem is that you ticked no on your application. You might be able to ask the police for information on the actual offence. You could then write a letter and explain the circumstances, i.e it occurred when you were a juvenile, that you ticked no because you received a warning and therefore did not associate this as being a conviction which is why you ticked no. Explain the incident, how you've never been in trouble again or involved in any such incidents. @Bouncy - I did think that no live trace meant there was offences but that they were not recent. It's been a long time since I did my police check, but it used to be No trace and No live trace - might be worth checking.
Bouncy
Thanks @ali your absolutely right, mine actually says no trace, doesn't take much to confuse me at the minute!! :-)
TheMackemSlayer
Hi again guys. I've had an email from my case agent since I last posted on here and she has asked me to write a personal statement on why I have something that has now been stepped down on my criminal record. Probem I'm having is that I can't remember much about the offence - no dates, age etc. Literally all I remember is that I was a teenager and was arrested for punching a guy (completely my fault, being a typical teenager thinking I was clever). Any ideas for how I could write one with so little information? As always, any help would be greatly appreciated.
Jueglittergirl
@TheMackemSlayer My OH had his PCC come back 'No Live Trace' our case offer asked us for a Subject Access Request from ACRO. The report detailed all the information needed, maybe this would be a better option if your unable to recall the details needed. We had our visa granted within 5 days following this report being uploaded.
