Also does anyone know if we are entitled to legal aid from the UK although we are no longer resident and if we can still be sued as a non UK resident? Any advice greatly appreciated! Druid Posted June 30, 2015 Report Share Posted June 30, 2015 Dont know about "Legal Aid" you normally have to qualify for it, which is means tested, and yes you can still be sued, it will be especially attractive by the person suing you as you are here in Aus and is extremely difficult for you to defend yourself from here and they could win and attach your house and any other assets you have in the UK, its complicated, sound like you need a solicitor, preferably one in the UK who obviously knows UK law, an Aussie solicitor might not know UK law. If you had no assets in the UK and got sued, you could choose to ignore it, the court will rule in favour of the person suing you and you will have judgement passed against you, which I think lasts 7 years, its not a criminal judgement, the police wont be involved or anything its a civil judgement. Get hold of the Citizens Advice Burea, they should be able to point you in the right direction of where all this is going. Quote Link to comment Share on other sites More sharing options...

Are you letting your property using an agent? If so they should be able to take care of any legal issues on your behalf. As far as I know you cannot get legal aid for a civil court case. Walkabout Posted June 30, 2015 Author Report Share Posted June 30, 2015 Thanks for the comments, we are just trying to get advice from the right person, being here we just dont have the contacts in the UK any more. We are through an agent and we are waiting to see what advice they give, however I wanted to get our own independent advice as well just to know that we are being given the right information. I am currently waiting on advice from a contract lawyer as I believe that is the area that the mess falls into. Does anyone know if it is only assets in the UK that they can chase or if they are able to chase assets in Australia as well?
