189 visa assistance if pregnant

Hi all, wondering if anyone can help? Currently on husbands 457 visa, he's lost job and so wer applying for PR via 189 as I'm a social worker and job is on skilled list. I have to have my qualification assessed via AASW (social work in oz) and then have to do my medical and ielts before lodging the visa. My question is this if I get pregnant how does this affect the medical? I've read threads that are a few years old but wanted up to date information. Will they allow the medical to go ahead or will it have to be deferred? If so does this mean I couldn't lodge an application as we only hVe 90 days to get our PR before 457 visa expires. Deffering the medical is your choice, but having an X-ray while pregnant is not recommended therefore most people defer until after the baby is born. As you are currently in Australia and looking to lodge application quickly you could go and do your medical now and get the medical id attached to your application after it has been lodged.

 

Medicals are are valid for 12 months, so if you do it now hopefully you will have your application granted before it expires. Also if you manage to gain PR before baby is born they will be an Australian citizen at birth if born in Australia.

 

If you do decide to defer the medical until after the baby is born, you are going to have issues with the 457 visa being cancelled and may end up on a bridging visa with no work rights.

 

Best speak to a registered migration agent to get thing done in the right order as if your husband has already lost his job you have 90 days to find a new sponsor or leave Australia. There is a lot of complicating factors with your situation and getting them wrong could mean that you may end up being unlawful in Australia.

thanks for your reply. I wasnt sure if I was able to get my medical done now as I would ultimately prefer to do it before I fall pregnant, I don't want to have to defer. I didn't know there was a timeline for it, I.e. Valid for 12 months, I thought medical had to be done just prior to application in case my health changes.

 

I also wonder if I could do my ielts now too so when my skills have been appropriately assessed I have all of the documents ready to do my EOI as I don't want any further delays

my hub hasn't been given redundancy yet but it's coming next week so we have about 4 months which I'm joint will give us time to get PR application in.

 

can you tell me about bridging visas do they have an expiry date and am I not able to work in them?

yes do your IELTS now it is valid for 3 years for visa purposes. Normally 2 years for the skills assessment.

 

Bridging visas normally have the same conditions as the current visa you are on and only come in to effect when your current visa expires not cancelled. If your visa is cancelled the bridging visa will also be cancelled. As you are on a 457 visa, your husband has a condition he must work for the sponsoring employer. So after he is made redundant before the PR visa is granted he will only be about to work if he can find an employer to nominate him for a 457. If your current visa has quite a bit of time left you will likely never be on a bridging visa. You will still be able to work on the 457 visa as you are not bound by the same conditions only your 457 sponsor as you are the secondary applicant.
