Where to start?

Hi

 

My wife and I are 29 and wanting to make the move over before we are 32. Looking through the pages and pages of the immi.gov.au website has me confused. We are unclear of the best option for achieving the visa. I thought it would have been the General Skilled Migration visa however I dont think ICT Support is on the SOL. State sponsorship for WA would mean I could get in under ICT Customer Support but then I believe it wouldn't allow me to live and work in Perth which is really where we want to be. I dont want to go too rural.

 

Has anyone done the assessments for ACS, what do they involve? ICT Support has many titles in the UK, one such Analyst title IS on the SOL but I dont want to sit an assessment for something that I am in no way suited to.

 

We are still looking at visa options and trying to put together a checklist of things we need to do before submitting the application. So suggestions and other peoples experiences would be greatly appreciated. My wife is a stay at home mum and we have 2 kids under 3 so we cannot really go under her profession.

 

At this stage I am trying not to fork out £3-4k on an agent, so hoping to find help within the community.

I got in touch with True Blue after reading a few online reviews of their service. They said I am eligible for a 457 Employer Sponsored, finding an employer who would not only hire but sponsor me without meeting me sounds far fetched. Does this actually happen?

 

As I have 7 years experience in my job, I now need to find records of all my training to see if it adds up to 900 hours. They said I need 5yrs exp and 900 hours formal training to be considered for state sponsorship to WA.

 

Has anyone had experience with these 2 visa methods or with True Blue?

The legislation for a 457 visa is quite complex. In brief in order to obtain a 457 visas, which is a temporary visas (not offering a pathway to permanency in its own right) the employer needs to be an appoved Standard Business Sponsor, they then have to apply to DIAC to get the position nominated and then the selected employee makes an application for a subclass 457 visa. These three processes have to be followed.

To answer your question, yes, some specialist skilled people do get sponsored for these visas, however you will need to find yourself a fulltime position with an employer who is prepared to go through this process and pay you the minimum salary specified on the Legislative Instrument??? That would depend on your skill set and employability in the Perth market. If you are an engineer or work in oil/gas/mining you have a great chance!

If you are skilled with an occupation on the ENSOL list it may be preferable to look at a 121/856 ENS visa or an RSMS visa if you find yourself an employer. If not you may wish to consider the various GSM categories.

Personally I have never heard of the hours training requirements you mention? However, as I say Migration Law is extremely complex, changes regularly and that is why we need a Degree in Migration Law to practice!! I am not saying that the advice you have been given is incorrect though, as your Registered Migration Agent would know more about you and your experience than I do!

Without finding an employer look at the SOL's for GSM and if you are short of points maybe consider a State Sponsorship?

I will take a look at those visas you mentioned. I work in IT support and am currently quite unaware of how much demand there is for those jobs in Perth. in fact I posted a question on the jobs section asking that very question earlier. My only idea at the moment is to contact companies with a letter and cv and see if anyones bites. State sponsorship was an idea I had as well, but I'm sure thats what the migration agent was talking about when she asked about 900 hours formal training and 5 years work experience. I know I've done about 280 hours of IT courses in the last few years as the company I work for has been great for training. I am hoping the little college I done when I was younger may make up the rest of the 900. I have asked the Scottish qualifications authority to resend my certs so I can check.

 

IT Support is on the sol for WA, but state sponsorship would mean I cant work in the Perth CBD where most IT jobs will be. Also if I am going to sell my house and move my family over, I need the visa to be permanent. I dont want to risk us all having to leave 2 years down the line.

I have looked and IT customer support is on the ENSOL list. The 121/856 ENS visa requires me to be in Australia when I applied for it but out of Australia when its granted? maybe I misread. Strange requirement if thats the case. The RSMS one wouldnt allow me to work in Perth, Im not sure if I would get much IT work elsewhere in the regions. I would also worry that if something happens in the first 2 years and I lose the job, including through redundancy, I would need to leave Australia.

 

These are all things to consider though, I must admit moving my family over and selling my house here is a huge thing and I would be worried to do it without reassurance of permanency. No doubt there is no reward without risk though.

Perth is classified as Regional for RSMS so you dont have to live in the middle of nowhere!

I still don't know the relevance of 900 hours ?? I would advise you look into that. I have not come across that with my clients!!

State Sponsorship effectively enables you to gain another 5 points for GSM but does not offer employment, I suggest you discuss these options with your agent. My clients are using State Migration as an option to improve their points. Check with your appointed agent which category they are suggesting for you! I am a Migration Agent and Specialist Recruiter and a good friend of mine is in IT support in Uk and we are struggling to find him an employer in Perth, however he is older than you and can not get enough points for GSM, so he needs to look at 457/ENS/RSMS. You need to ascertain which ANZCO your occupation is under!

Ive only sent a few emails back and forward with True Blue, we havent actually appointed them as agents yet. Its all very early days.

 

As for the ANZCO, these seem to fit:

I looked back at the emails from True Blue, after they suggested the 457 I asked about state sponsorship as an alternative to that. they responded with:

"Can you confirm if you have completed formal IT training (of at least 900 hours)?

Please send a CV and I can assess you for a skilled visa.

 

You need to show at least 900 hours of training and then five years of work (your work experience is fine)."

Good luck with it all, it sounds as if you are looking into the ANZCO with regards to skills assessments and possible State Sponsorship. As long as your migration agent is registered with MARA https://www.mara.gov.au/agent/ARSearch.aspx?FolderID=394 you should be in safe hands. All skills assess and visas require different compentancies, both in regards to employment and the English language criteria, so you need to have an in depth look atg the various SOL's and ENSOLs etc to see what you need. Only use an agent who is registered with MARA . Under Australian Law it is illegal to provide immigration assistance without being a qualified registered agent, unfortunately outside of Australia there is no jurisdiction.

 

There is currently a huge amount of confusion regarding the new legislation of Perth being designated regional, so you are not alone!!
