From 457 visa to PR

Hi there,

 

My husband is a dentist and he is going to work in the public sector in rural area of Western Australia. Meanwhile he has to sit the Clinical exam of the Australia Dental Council to get his full license. We understand that he needs to pass the clinical exam to get the full license so as to be eligible for PR application. However, if we want to get the sponsorship from employer to support our application of PR, should we have to stay with the same employer for a certain period until we get the sponsorship or can we get the sponsorship from private health care companies?

Ok, if I understand this correctly you are going on a 457 Visa initially which is sponsored, you can only work for the 457 sponsor, if you stop working for the sponsor of the 457 visa you get 28 days to find another 457 sponsor or leave the country, in the meantime you want PR, the easiest way would be to ask your current sponsor of the 457 visa to sponsor you again for an ENS or if your regional an RSMS Visa.

 

You could go find another sponsor for the ENS or RSMS but you stand a good chance of upsetting the 457 sponsor, and he could withdraw his sponsorship, then you are back to the 28 day rule, if you do get the ENS or the RSMS ,visas granted both have clauses which bind you to the sponsor for 2 or 3 years.

Thanks, Druid. Yes, you understood this correctly. Do you know how long does it take usually to get the PR under an ENS or RSMS? Perth should be considered as regional area as I understand.

 

So, if I change sponsor for the ENS or RSMS, will the new sponsor need to nominate me for another 457 visa while I am waiting for the grant of PR? That means I risk losing the visa if there is any problem between the switch of jobs, and I have to leave Australia. Is that true?

 

Who decides the number of years of binding?

When I looked into ENS Offshore it was going to take about 8 Months, this is why I ended up on a 457 now, I'm not sure about ENS Onshore, I can't see it being much quicker, I will let you know after xmas when I apply, I have had an RSMS Visa before and the whole deal only took 3 Months and I had to re-apply in the middle of it all because my employer made a mistake on the nomination.

 

Yours new sponsor for the ENS / RSMS will not need to nominate you for a 457 IF your current 457 sponsor is happy for you to find another sponsor for PR, if you upset your current sponsor to the point where he considers you to be in breach of your visa, he can have your visa cancelled and you will have 28days to find another sponsor or leave the country, obviously DIAC will also be involved, so unless you have broken the terms of the visa DIAC will be sympathetic. Finding another sponsor is not in breach of your visa by the way

 

The number of years binding is a condition of the visa, so DIAC have decided, in both cases DIAC stipulate a minimum wage during this period so you can't be taken for a ride during this time, unfortunately the minimum wage is rediculously low.

Why doesnt your husband apply for GSM Skilled Independant Visa? Then he doesnt need to rely on an employer. Once he has gained his license and Australian work experience that may be the best option for him.

Hi Juliana

Processing times do vary, but generally ENS and RSMS visas are going through in about 5 months if all the documentation is provided. Registered Migration Agents are able to lodge Decision Ready Applications which basically means that they have been thoroughly checked to make sure that everything DIAC needs is there. 457's can go through as quick as 11 days, a colleague of mine sent one off on the Friday and visa was granted on the Monday morning! VERY UNUSUAL, he must have broken a record, but obviously sent a very thorough submission with it. 176/886 State Migration Plan Sponsored GSM's are going through quicker than Independant skilled and from low risk countries are taking less than a year. Independant GSM are roughly 18 months, however please note these are only an indication of processing times, some go through very quickly if the agent has a thorough case. You could always consider lodging onshore once you have gained Australian experience. Subject to the type of visa you enter Australia on, most substantive visas will allow lodgement of another visa and entitle you to a Bridging Visa A whilst waiting for the decision of your new application.

Hope that helps. There is so much confusion with RSMS at the moment with regards to Perth becoming regional and there are currently changes going through with regards to Labour Market testing.

It may be worth your while looking on the State Migration Plan and seeing whether or not your occupation is on the list for GSM.

Hi

I am being sponsored on 457 (I'm a midwife), but we want the security of PR so have also begun our application for the skilled independent visa. It means we can get to oz sooner and be there whilst our PR is being processed. I know it's a bit of belt and braces approach and it's very unlikely I would loose my job but would rather have sorted PR independently and not be tied to one employer ( though am very grateful for them for sponsoring me on a 457).

I have a migration agent helping me with the independent visa and my new employer is sorting the 457.
