aussiebird2012
Hello, I am new to this forum and would like some advice please? If a former resident who is outside Australia goes back to Australia and they entered the country on a visitor visa because the travel part of a partner visa expired and they weren't aware of a resident return visa at the time, will they lose there permanent residency status? Is there a chance of being granted a 3 month RRV as wanting to move back to Australia or would another partner visa have to be applied for. Previous partner visa expired in 2016 and we have been back in UK since May 2014. Hoping to move back to Australia permanently at the of 2020. I would be grateful of any advice, thank you so much. FOL
If it expired it expired. Buuut you can contact immigration and present your case. In certain cases thwy give you slack and you can get an RRV for your permanent visa. Look around at stories about that and what worked and what didn't. Are you still with the same partner? Is the partner a citizen? If not, things get complicated imho. But I qm no visa specialist just seens some stories on expired visa.
verystormy
All you can do is apply. Though you might want to check vevo first to see what is the current visa status in case the visitor visa has cancelled the partner visa. ali
Hi Aussie bird, Are you the same Aussiebird who is on our sister site Poms in Oz? If not, it might be worth looking at the responses to the same question, which advises to speak to a Registered Migration Agent.
JaseandAnne
Hi, As I understand it you will be a permanent resident if you have satisfied the entry requirements of the visa when it was first valid, for example our visa required us to "activate" the visa by visiting or moving to Australia within the 12 months from date of grant. Then the travel part of our visa was valid from the date of visa grant for 5 years. This has now ran out and whether inside australia or out you have to apply for an RRV. You will always be a permanent resident however they don't have to issue you with an RRV.

It is understood from an agent that my O/H will now be a former permanent resident because he went back to Australia on a visitor visa instead of applying for a RRV, so that cancels any substantive visa/permanent resident status. It may be that he can get another RRV as the agent says but as we cant go back to Australia until end of 2020 (sons GCSE exams 2020) anyway so no point in applying for one now as it will be too soon. It may well be that he will apply for another Partner Visa so he can get 5 years and work towards his citizenship. .
