Sorry to read this Paul, I hope you and your family settle back in the UK quickly.

At least you won't look back on life and think "what if". You gave it a shot and it didn't work out this time but you still have the option to go back if you decide that's the right thing to do. I wish you all well.

Cheers Guys , we are settling back into work / home life ..... but constantly on our mind is the fact that our perm visa will expire 2021 , So if we are heading back we need to do so before then.  But we had a great time and stacks of happy memories and if it wasnt for the circumctances we would still be there ........ We just had to think on our feet and return to get clarity !

And yes we wont be strangers - As feel we may need advice pretty soon ;o)

Will just add Paul, it isn't your visa that expires, that never does, but only the travel part. You would probably get a 5 year RRV if you applied for one when the travel part expires, giving you another 5 years.

Interesting you say that VS, I had a RSMS Visa 'Expire' on me, I was only here for 6 months on it in 2005, , when I looked into returning on it, was told I needed to do 2 out of the 5 years before it 'expired', hence coming in on a 457 initially, then switching back onto another RSMS

Things may have been different in 2005, but today, the department use a very big discretion is RRV's and in your circumstances you would pretty much have been certain to get an rrv. Also, there are two criteria to an rrv. Two years living in Oz or substantial ties. A job offer is regarded as substantial ties.

Well as Pegg was only here for one year would not qualify for a 5 year RRV as you advised

It was in 2010 when I enquired about the status of my visa, as was told by DIAC that I needed to return before 7 March or I would need another visa.

But, as I said the department treat RRV's with a big discretion. For example, I have seen people get a five year rrv after never living in Oz and years after the expiry of the PR travel rights. In fact it is fairly common.

I know this may sound odd, but if you haunt the migration / visa boards of PIO as I do, the first thing you learn is never ever under any circumstance take advice from DIAC. The reason being is you are not speaking to case officers but to call centre staff who have had minimal training. Hence why the department has a legal immunity from legal action for advice given. If you complain on bad advice you get a  standard response saying you should have consulted a registered migration agent.

On PIO we regularly see people in all sorts of messes after following department advice.

Agree with that VS.   I always suggest that if people have a question that can't be easily answered from the DIBP website, then they need to consult a Registered Migration Agent.   So much better to pay a fee and receive correct advice, than rely on a call centre person who is not registered to give migration advice.   At least that way you know for sure where you stand and can make decisions based on correct information.

Hi Paul,

What a shame to hear.

It is not easy to settle in a different place, even if that different place is what you called home not too long ago. You change quite a bit feom migrating to and living on the other side of the world.

Try to make best of it. It is a silly nobrainer, but it's easy to get caught up daydreaming about another place and not really living your existing life any more. Easier said them done though! I know I messed up 3 years od my life this way.

Anyway, take care and all the best. Hopefully you and  your family will sort everything out.
